For persons who are caught in a debt trap or heading towards it, Individual Voluntary Agreements (IVA) offer them a government sponsored solution to free themselves from debt. The IVA, which is governed by the Insolvency Act of 1986, is a formal agreement between the debtor and his creditors, whereby the debtor agrees to repay his creditors over a specified period of time (usually five years). This solution can help a person regain a healthy financial status at the end of the five year period. The advantage of IVA over other non regulated schemes such as Debt Management Programs is that they are legally binding since the government backs Individual Voluntary Agreements and a Licensed Insolvency Practitioner supervises the agreement.
Individual Voluntary Agreements are available to any individual, sole trader or partner who has been unable to repay his creditors for a short period and is now coming under the pressure of having his property attached in case he is declared bankrupt. Individual Voluntary Arrangements are an excellent solution for persons who are facing a temporary set back in their finances but are expecting a revival soon. However, as is the case with other debt management programs, IVAs have their advantages and disadvantages.
What does a late tax filer, a taxpayer who donated to a “bogus charity” and a taxpayer with undisclosed offshore income have in common? Well, if the CRA hasn’t contacted them yet, they all may be able to file an application under the Voluntary Disclosure Program and avoid penalties.
The Voluntary Disclosure Program was put in place so that taxpayers could come clean about undisclosed income. To be approved under the Voluntary Disclosure Program you must meet four criteria.
1. Disclosure must be voluntary. If the CRA has contacted you to request that you file a return, or has requested information about a return that was already filed, disclosure would not be considered voluntary.
2. The tax year(s) in question must be at least one year old.
3. Disclosure must be complete.
4. The tax debt must involve a penalty.
If you meet all of the criteria, the Voluntary Disclosure application process is as follows:
1.
An initial application is submitted to the CRA including all pertinent details that include but are not limited to the tax years in question and amounts of income that was not disclosed.
2. Once the CRA has received your request they should reply within 60-90 days. They will send a letter that will indicate the application number and the VDP officer who will be responsible for the file. You will then have 90 days to amend or file the tax returns for the tax years in question.
3. Once all of your paper work is filed, the VDP officer will review your request and determine if the VDP application will be approved. It is at this time that the CRA will check to see if your application qualifies by determining if disclosure is voluntary, complete, involves a penalty and is at least one year old.
The Voluntary Disclosure Program is an official process that could take as long as six months to complete and should be handled by a professional.
Chartered Accountants are seasoned experts in navigating CRA policy and procedure and are the best choice if you are considering making a disclosure to the Canada Revenue Agency under the Voluntary Disclosure Program. They can also prepare the required tax returns or amendments to past tax returns.
There are many benefits to coming clean and disclosing income that you know you earned, under the Voluntary Disclosure Program. These include; avoiding penalties, prosecution and also coming to terms with your tax debt and putting it behind you.

First and foremost, when starting a non profit collective you should know that your entire operation depends on your motives and influence the decisions you make regarding your patients and community. If your motive is compassion, your actions will reflect it. You should keep in mind that if you are insincere, you put yourself and others at risk.
Before you know can get to how to start a non profit collective, the first thing to know is what a medical cannabis dispensing collective/dispensary (also called cannabis centers or compassion clubs) is. It is a legal organization which provides medical marijuana to its members. This makes one wonder on how to start a non profit collective and how this is possible.
There are certain state laws which allow marijuana to be cultivated for medicinal purposes and the state health and safety codes allow certain organizations to collectively or cooperatively do so. All the patients and their primary caregivers are legally-qualified. Though laws aren’t very clear about the collective or the organization nowhere does it say that medical cannabis can be grown for profit i.e., it can only be for a non profit organization. No matter the type of organizational structure, any organization can referred to as not-for-profit business if reinvests the revenues in the service of its member or any other type of noncommercial activity. A not-for-profit organization shouldn’t be confused with non-profit organizations (such as schools, churches, hospitals, etc) which are exempt from paying taxes as they do educational, religious or charitable work. However, providing medical cannabis is not seen as a tax-exempt activity and under the state laws will still have to pay taxes
The medication should always be obtained from its registered members, which may seem as a challenge for new dispensing collectives. Also, it is important to build a membership base before having a wide selection to offer them.
The most important piece of advice anyone can give you on how to start a non profit collective is to keep the legal jargon on the tip of your tongue to avoid legal risks for example, calling ‘Marijuana Cannabis’, buying or selling as acquiring or providing. Using proper terminology is bound to influence those around you.
You should always keep in mind that marijuana remains illegal under federal laws although some states and cities have adopted the medical marijuana patient programs. You should check with a legal advisory to explain the state requirements on how to start a non profit collective and keep the necessary marijuana business papers (the licenses, the business permits etc).
